Limited Three-Year (3) Warranty of WCO Sales & Supply Unltd.

In connection with and in consideration of the sale of a certain computer system by WCO Sales & Supply Unltd. of Kokomo, Indiana WCO to Purchaser, WCO extends to Purchaser a Limited Warranty covering the computer system component parts and labor provided to the Purchaser.

WCO warrants and agrees to repair any of its work or replace any component parts which are defective, faulty or otherwise which fail to substantially conform with the express terms of the sale. This warranty is extended to Purchaser for the period of Three (3) years from the date of purchase, which period is defined to commence on WCOs’ date of final invoicing. For Purchaser to invoke the warranty remedies set forth herein, Purchaser must give WCO Notice within 10 days or the occurrence or manifestation to Purchaser of the defect, and within the three-year warranty period, specifically identifying the alleged defect and its alleged cause. Failure of Purchaser to give timely notice renders this warranty void and releases WCO of all obligations in connection therewith.

THE WARRANTIES SET FORTH HERIN ARE IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, AND NO OTHER REPRESENTATION, WARRANTIES, PROMISES OR STATEMENTS HAVE BEEN MADE BY WCO WITH RESPECT TO THE COMUTER SYSTEM SALE DESCRIBED HEREINABOVE, AND THE LABOR OR PARTS COVERED BY THIS WARRANTY. ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY DISCLAIMED BY WCO.

LIABILITY FOR CONSEQUENTIAL DAMAGES UNDER ANY AND ALL WARRANTIES IS EXCLUDED TO THE EXTENT EXCLUSION IS PERMITTED BY LAW, WCOS’ LIABILITY SHALL BE LIMITED SOLELY TO THE REMEDIES EXPRESSED IN THIS WARRANTY.

This is the sole and exclusive remedy and warranty of WCO. However, WCO transfers, conveys, and assigns to purchaser any and all manufacturer’s warranties of the component parts installed by WCO in connection with the sale of this product to Purchaser.
